                   *So Guys Today We gonna discuss about who is Orphan, what is eligibility is necessary to adopt a child, When a child can be adopted and How can a person adopt a child?

Who is the orphan?

Under India's immigration law, an orphan is a child of foreign origin who is not: caused by the death or disappearance of the parent, abandonment or deportation by the parent, or separation or loss from the parent. Or a single or surviving parent, who is unable to care for the child, conforms to the local standards of the foreign sending country, and who has, in writing, issued the child for emigration and adoption. You must file an orphan petition before the child's 16th birthday or before the child's 18th birthday if the child is the birth of another child, which you have also adopted and which is unaffected (or will be obsolete): based on a form But an orphan I-600 petition was filed as the brother's 16th birthday or "adopted child" as defined in section 101 (b) (1) (INA) of the Immigration and Nationality Act (INA), provided the actual Adopt Made before the 16th birthday of brothers and sisters. Overseas Investigations As part of the processing of its case, it will investigate overseas to verify that the child is an orphan. The purpose of the investigation is as follows: Confirm that the child is an orphan as defined in the Indian immigration law. Verify that you have received a valid adoption or custody grant. The child does not have an illness or disability not described in the orphan petition. If the child has any special needs that have not been fully addressed in your home study if there is a fact that indicates that the child Determines if your adopted child is not eligible for immigration. 


1.who is eligible for Child Adoption?

                    In India, the adoption process is overseen by the Central Adoption Resource Authority (CARA), the nodal agency for monitoring and regulating country and inter-country adoption and is a part of the Ministry of Women and Child Care. Following are the basic conditions that parents need to be satisfied to adopt so that the child can be eligible for adoption:
  • In India, a child can be adopted by an Indian citizen, NRI or a foreign national. The adoption process is different for all three.
  • Anyone is eligible to adopt anyone, regardless of their gender or marital status.
  • If a couple is adopting a child, they must complete a stable marriage of at least two years and have a joint consent to adopt the child.
  • The age difference between the child and adoptive parents should not be less than 25 years.
2. When can a child be adopted?
  • According to the guidelines of the Central Government of India, any orphan, abandoned or surrendered child, declared legally free to adopt by the Child Welfare Committee, is eligible for adoption.
  • A child is called an orphan when the child is without a legal parent or guardian or the parents are no longer able to take care of the child.
  • A child is considered uninhabitable or unacceptable by a parent or a guardian and the Child Welfare Committee has announced the release of the child.
  • A surrendered child is one who has been abandoned based on physical, social and emotional factors that are beyond the control of the parent or guardian and therefore declared by the Child Welfare Committee.
  • For adoption, a child must be "legally free". Upon receipt of an abandoned child, the District Child Protection Unit gives a warning with a photo of the child and details in state-wide newspapers and requests the local police to locate the parents.
  • The child is considered legally independent to adopt, when police report that the child's parents are non-traceable.
3. There are some certain phase have to follow if you want to adopt any children from any Orphan House?

Phase 1-Prospective adoptive parents are required to be registered with an authorized agency. For Allowing such types of regulation in India there are two types of Accredited Indian Placement Agencies (RIPA) and Special Adoption Agency (SPA). Prospective adoptive parents can visit the adoption coordination agency in their area where the social worker will explain the process and take you through the necessary formalities, paperwork and general preparation for registration.

Phase 2 - Home Study and Counseling
A social worker for the registration agency will visit the home of prospective adoptive parents to study at home. The agency may also require parents to participate in counseling sessions to understand potential parental motivation, preparation, strengths, and weaknesses. From the date of registration within 3 months Home studies must have to compete as per CARA guidelines.
The findings from the home study and counseling session are then reported to the Honorable Court.

Phase 3 - Child Referral
When the interested child is ready for adoption, the agency will inform the interested couple. The agency will share medical reports, physical test reports and other relevant information with the couple and also allow them to spend time with the child if they are comfortable with the details shared.

Phase 4 - Approval of the child
Once a parent is comfortable with a child, they will have to sign some documents related to the child's acceptance.

Phase 5 - Petition
All necessary documents are presented to a lawyer who prepares a petition to be presented to the court. After the petition is ready, the adoptive parents must visit the court and sign the petition in front of the court official.

Phase6 - Pre-Adoption Foster Care
Once the petition is signed in court, the adoptive parents can take the child to a pre-adoptive foster care center and understand the child's habits from the nursing staff before taking the child home.

Phase7 - Court Hearing
Parents have to attend a court hearing with the child. A closed-door hearing is held with the judge. The judge may ask some questions and will refer to the amount which needs to be invested in the name of the child.

Phase 8 - Court order
Once the receipt of the investment made is shown, the judge will pass the adoption order.
